The cancellation of the registration of all six of the Washington Redskins’ trademarks by the TTAB in 2014 was upheld last week when Pro-Football, Inc.’s motions for summary judgment were denied in federal court. In the same decision, the Blackhorse defendants’ cross- motions were granted. Litigation surrounding the trademarks has been ongoing since the 1990’s and will apparently continue since a Redskins spokesman stated in a New York Times article that they intend to appeal. Although the common law rights to their trademarks remain, loss of registration means the team’s protections against counterfeit products are limited. See The New York Times. The recall of up to 34 million Takata airbags installed in vehicles of at least six automakers worldwide, and the filing of more than 70 proposed class actions, is not enough to convince the company to agree to create a compensation fund similar to the fund launched to handle the faulty ignition switch claims against GM. Senator Richard Blumenthal, a Democrat of Connecticut, urged the company to consider establishing the fund, in part, to help uncover more victims. The company declined, apparently preferring to handle cases in the consolidated litigation assigned to the Southern District of Florida last February by the U.S. Judicial Panel on Multidistrict Litigation.
