Last week a federal jury in Madison awarded $234 million (less than the $400 million sought) in damages to Wisconsin Alumni Research Foundation (WARF) for Apple’s infringement of a patent for microchip technology held by the University of Wisconsin. While Apple was able to avoid a finding of willfulness, along with the assessment of triple damages, the cost of their unsuccessful defense is significant and may be ongoing. WARF filed a second lawsuit in September alleging similar patent infringement by some of Apple’s newest products.
